1. Acceptance of Terms

By creating an account, accessing, or using Biolinker.me (the "Service"), you agree to be bound by these Terms. If you do not agree, you must cease using the Service immediately.

2. Absolute Disclaimer & Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Biolinker.me AND ITS OWNERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO:

LOSS OF REVENUE OR PROFITS: Any loss of business, sales, or data resulting from the use or inability to use the Service.
INACCURATE INFORMATION: Any errors, omissions, or inaccuracies in the content, products, or documentation provided.
PRODUCT USAGE: Any damages or injuries (physical or mental) arising from the use of digital products purchased or downloaded.
SERVICE INTERRUPTIONS: Technical failures, server downtime, or loss of access to your account/links.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind.

3. Content Moderation & User Content

Illegal content or content that is deemed harmful to Biolinker.me will be removed immediately and without prior notice . We reserve the right to terminate accounts that violate these standards or engage in activities that may damage the reputation or technical integrity of the Service.

Content Rights: By uploading content to the Service, you grant Biolinker.me the right to use, host, and display said content as part of providing the Service.

4. Digital Products & EU Withdrawal Rights

Purchases of digital goods, subscriptions, or premium features are final. Pursuant to the EU Consumer Rights Directive, you expressly consent that the performance of the contract begins immediately upon purchase or access, and you acknowledge that you thereby waive your 14-day right of withdrawal (refund).

5. Privacy & Data (GDPR)

We process your data according to the General Data Protection Regulation (GDPR).

Payment Processing: We use Stripe for secure payment processing. We share necessary transaction data with them, but we do not store full credit card numbers on our servers.
Infrastructure: Our Service is hosted using Hetzner. Data is handled with the highest regard for security and EU compliance.
Data Retention: We store your email and account info as long as your account is active. Transactional data is kept for 5 years to comply with accounting laws.

6. Data Processing Agreement (DPA)

This section constitutes a binding DPA under Art. 28 GDPR . Biolinker.me acts as a Processor for any third-party data (e.g., visitor IPs) processed through the user's links.

Instructions: Processor shall only process data to provide the service as instructed by the User.
Sub-processors: User authorizes the use of Stripe (payments) and Hetzner (hosting).
Breach Notification: We will notify you without undue delay after becoming aware of a confirmed personal data breach.

7. Indemnification & Force Majeure

7.1 Indemnification

You agree to defend, indemnify, and hold harmless Biolinker.me and its operators from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the Service, a breach of these Terms, or any content posted on your biolink page.

7.2 Force Majeure

Biolinker.me shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond our reasonable control.

7.3 Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law.
